“Account” shall mean the electronic file record together with certain data and information provided by an individual (“Account Holder”) whom is an Original Purchaser (as defined below) for the purchase of any Tickets online or over the phone, that may be provided at the time of purchase or at any point thereafter.
“Account Data.” Each Account may include information about each Account Holder including but not limited to name, birthdate, address, phone number, email, account number and current transaction information and information which is otherwise known as Personally Identifiable Information, biographical or qualitative information, records of customer service inquiries, past transactions and invoices, the last four digits of the valid credit card on file for identification and verification purposes only, and any and all other information provided voluntarily by Account Holder or as required by Gotham or Ticket Agent to maintain an active Account in good standing (collectively “Account Data”). Gotham shall keep Account Data in accordance with its Data Privacy Policy and unless otherwise requested or indicated by Account Holder, Gotham shall use the information therein to easily identify, communicate and process transactions related to the purchase of Tickets, to sell Account Holder additional ticket products, goods or services, in aggregate and anonymized with other data to evaluate, improve, or review ticket sales, ticket products, marketing or advertising activities, and share it with Ticket Agent or other third parties necessary to process the ticket purchase, the ticket distribution, or security or other screening requirements at the point of entry in Red Bull Arena or any venue, and unless otherwise limited, for any other commercial purposes. Notwithstanding the foregoing, Gotham does not sell Account Data for any commercial purpose. All non-required information requested by Gotham or Ticket Agent is provided by Original Purchaser on a voluntary basis . The Account stored by Gotham is separate and distinct from that which may be generated, created, managed, and secured by Ticket Agent. Certain elements of Account Data may be separately stored by Ticket Agent together with additional information, including as my be required by Ticket Agent a valid and unexpired credit card number, and which is solely and exclusively managed by Ticket Agent and used, stored and managed in accordance with its own privacy policy and terms and conditions as provided by Ticket Agent through its ticketing system. Gotham does not store credit card numbers in its Account Data, however may store the last four digits of the most recently used credit card by the Account Holder for verification purposes only.
“Account Manager” shall mean the online/website based portal provided by Gotham and Ticket Agent which may contain some or all of the Account Data together with other Account Holder information, and which serves as the primary portal for Account Holders, and Original Purchasers to access, manage, resell, and transfer their Tickets to Events, including the review of invoices and addition of or editing of required Account information.
“Codes of Conduct” shall mean the terms of the Gotham Fan Code of Conduct, Red Bull Arena Policies and the terms of any Promoter code of conduct and /or any other code of conduct that may from time to time be changed, amended or modified by any venue where an Event is scheduled to occur.
“Event(s)” shall mean any ticketed Gotham match, including but not limited to regular season, playoff, exhibition, international friendly, or any other competition- hosted by and ticketed by Gotham on behalf of or in partnership with any organizing entity, including Major League Soccer, US Soccer Federation, CONCACAF, NWSL or FIFA or their agents, subsidiaries, and designees (collectively “Promoter”)—match, or group of matches where a ticket is required for entry.
“Event Cancellation” or “Event Disruption” shall mean any circumstance which forces a change to one or more Events, including (a) when an individual Event or group of Events is cancelled and not rescheduled (“Event Cancellation”); (b) when an individual Event or group of Events is not able to be hosted with fans or with limitations on venue capacities; or (c) when an Event or group of Events is disrupted, interrupted or otherwise rendered impossible to host as originally scheduled (collectively “Event Disruption”). Cancellation or Disruption of an Event or Events may arise for any reason whatsoever, including but not limited to any circumstances outside of Gotham or the NWSL or other Event (as that term is defined below) Promoter’s (as that term is defined below) control such as, acts of God (fire, flood, storms, hurricane, earthquakes, tornadoes, etc.), acts of terrorism or public enemy, war, civil disturbance, sabotage, accidents, insurrections, blockades, communicable disease or contagion (including Covid-19), acts of any governmental or quasi-governmental authority, labor strikes, lockouts or other labor disturbance or interruption or any other like event.
“Facility/Facilities” shall mean all locations or venues where a Ticket to an Event is offered for sale by Gotham, including primarily Red Bull Arena located in Harrison, New Jersey, but may include additional venues on an Event by Event basis.
“Mobile Ticketing” shall mean the purchase, use, receipt, maintenance or management of any Ticket via any official Gotham Mobile Application, the official mobile application of Ticket Agent, and specifically including the use of features commonly referred to as a “passbook” or “wallet” on a mobile device, , or other approved digital methods to access and manage tickets. An Account Holder may be provided access to a Mobile version of their Account profile through a Mobile Ticketing platform. Access to Mobile Ticketing may require opting-in to certain tracking features or location services or notification services and separate data privacy policies. Gotham is not obligated to provide Mobile Ticketing to any Account Holder.
“Mini-Plan Purchaser” or “Mini-Plan Purchase” shall mean any individual or entity who purchases a ticket or tickets for a specific group of Events, that is offered as a multi-match package which includes more than one (1) match and less than all matches, as designated at any time by Gotham
“Original Purchaser” shall mean the individual whom purchases a ticket or tickets (including group tickets) for any Event or group of Events, including Mini-Plan Purchasers and Gotham Season Members, directly from Gotham, the ticket box office located at Red Bull Arena or through Ticket Agent on a primary purchase basis only. Original Purchaser does not include a Ticket Broker or a purchase from a Ticket Broker (as that term is defined below).
“Privacy Policy” Gotham does not solicit or intend to store any information for children under the age of thirteen (13) in compliance with COPPA and other state and local law as part of its Ticket process or in Account Holder Accounts. Certain items of Account Data must be maintained and used by Gotham and/or Ticket Agent and/or the NWSL in order to process, manage and administer the Account, the Ticket or the Event as permitted by law, even where Account Holder otherwise opts out from certain communications or data usage.
“Refund” shall mean a return of the full face-value amount of the Event ticket price, not including taxes, facility fees, or service fees associated with the original charge or the refund, to the Original Purchaser in the original form of payment. All refunds will be processed within thirty (30) days of notice of refund confirmation by Gotham to the Original Purchaser.
“Reschedule” or “Rescheduled Event” shall include any circumstance where the date, time, location or opponent for a specific Event is changed by Gotham or NWSL.
“Season Ticket” shall mean the revocable license to use a designated seat and/or location at the Facility for viewing designated home games of Gotham that occur during the official NWSL regular season as determined by the NWSL each year, but may also include additional matches that take place throughout such year as Bonus Matches, as defined in the Gotham Season Membership Agreement.
“Gotham Season Member” shall mean any individual or entity who purchases or renews a Gotham Season Membership.
“Secondary Purchaser” shall mean any individual or entity who is not an Original Purchaser who purchases a ticket or tickets for an Event or Events from an Original Purchaser, a ticket reseller or other vendor in the secondary ticket market, or who receives a ticket or tickets for an Event or Events by transfer from any person or entity, including but not limited to the Original Purchaser. Gotham or the NWSL may restrict the onward transfer or sale of any Ticket to any Event by Original Purchaser for any reason.
“Single Match Purchaser” or “Single Match Purchase” shall mean an individual or entity who purchases a ticket or tickets for an individual Event.
“Ticket Broker” shall have the meaning set forth below.
“Ticket Holder” shall mean any individual who possesses a valid, unused Ticket in any format, including a digital or printed copy displaying a barcode which is capable of scan, for an Event. All Ticket Holders agree to be bound by any terms printed on the Ticket (including whether appearing on the back of a Ticket, on a Ticket PDF printed out, or on a digital Ticket on a mobile device) and the Codes of Conduct. Ticket Holders are not guaranteed entry into any venue, and Gotham and/or Red Bull Arena reserve the right to refuse entry to any Ticket Holder at its/their sole and exclusive discretion. As a condition of entry into any Event venue, the venue manager may require any Ticket Holder to undergo security screening, health screenings, pre-arrival questionnaire submissions, including the designation of prohibited items and or restricting the size and type of bags and acceptable personal property to be brought into the venue.
“Ticket Transfer” shall mean the forwarding, distribution, transfer or sale of an Event Ticket or Tickets to any person, whom is an Original Purchaser, in any format, including via their Account Manager or Mobile Ticketing platform, where they are authorized to access those Tickets, or via any other third-party platform, to another individual whom is not the Original Purchaser or from a Secondary Purchaser to another Secondary Purchaser. Gotham may at any time make any Ticket non-transferrable and disable any transfer feature within its Mobile Application or Ticket Agent mobile platform.
Items may not be constructed or displayed in a manner that may obstruct the view of other guests or in any way create a safety hazard for others as determined by Facility management staff.
Banners signs and flags are permitted during Gotham matches as long as they do not obstruct the view of guests or block Facility signage and must meet the following requirements:

1. Eligibility. GOTHAM FC US SOCCER Sweepstakes (the “Promotion”) is open only to legal residents of the states of New Jersey, New York and Pennsylvania who are eighteen (18) years of age or older at the time of entry (an “Eligible Entrant”). Employees, officers and directors, including immediate family members (spouse, domestic partner, child (biological, foster or adoptive), sibling, or parent (biological, foster or adoptive) and their respective spouses/domestic partners, regardless of where they reside), and members of the same household, whether or not related, of the NJ/NY Gotham Football Club LLC, the National Women’s Soccer League, LLC, the United States Soccer Federation, Inc. and each of their respective parents, affiliated companies, subsidiaries, licensees, divisions, members, teams and any and all other companies associated with the Promotion (collectively, the “Promotion Entities”) are not eligible to participate or win a Prize. The Promotion is subject to all applicable federal, state and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation. Participation constitutes entrant’s full and unconditional agreement to these Official Sweepstakes Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion, including but not limited to the administration and operation of the Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein.
2. Promotion Period. The Promotion will begin on August 15, 2024 at 8 a.m. Eastern Time and end on August 22, 2024 at 12:00 p.m. Eastern Time (the “Promotion Period”). All entries must be received by Sponsor by the end of the Promotion Period. Sponsor reserves the right to extend or shorten the Promotion Period in its sole discretion, and to cancel, terminate, modify or suspend the Promotion for any reason in Sponsor’s sole discretion. Sponsor’s clock shall be the official clock of the Promotion.
3. How to Enter. There are two (2) ways to enter the Promotion:
a. Data Form Submission. Eligible Entrants may go to https://share.hsforms.com/1SlkUTj2pTnaHz9ScUIRYdA2qnqi and complete the online entry form in its entirety.
b. Mail Form Submission. Eligible Entrants may enter by mail by sending their name and email address to NJ/NY Gotham FC GOTHAM FC US SOCCER, 15 Exchange Place, Suite 1000, Jersey City, NJ 07302.
Limit one (1) entry per Eligible Entrant and Eligible Entrants may only win one (1) Prize. No other form of entry will be accepted other than as described above. In the event of dispute over the identity of an Eligible Entrant, an entry will be deemed made by the Authorized Account Holder of the e-mail address submitted at the time of entry, and the Potential Winner may be required to provide identification sufficient to show that he/she is the Authorized Account Holder of such e-mail address. The “Authorized Account Holder” is deemed the natural person who is assigned to the e-mail address in question by the applicable Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted email address. It is solely the responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her e-mail or postal address.
4. Winner Selection. Sponsor will randomly select one (1) entry from all Eligible Entrants after the Promotion Period ends (a “Potential Winner”). Sponsor will attempt to contact the Potential Winner(s) in the manner described below. Should a Potential Winner not meet the eligibility criteria or the entry be found, in Sponsor’s sole discretion, to not comply with these Official Rules, such Potential Winner will be disqualified and Sponsor may select an alternative Potential Winner.
5. Winner Contact. Sponsor will attempt to contact each Potential Winner via e-mail within one (1) week after the end of the Promotion Period. Each Potential Winner who responds to Sponsor’s message and complies with all other terms of the Official Sweepstakes Rules, is a “Winner.” If a Potential Winner cannot be reached during such period or fails to respond to Sponsor within twenty-four (24) hours after said message is delivered, such individual will be disqualified and an alternative Potential Winner will be randomly selected from the remaining Eligible Entrants and contacted. Such process will continue until Sponsor contacts the number of Winners to award all Prizes. At all times, Sponsor reserves to right to select an alternate Winner in the event that a Winner is found to have not complied with these Official Sweepstakes Rules.
6. Prize Descriptions; General Prize Terms; Value.
Prize Descriptions. The Winner will receive two (2) tickets with Audi Club access to two (2) Gotham FC home matches at Red Bull Arena, Harrison, NJ on their choice of dates remaining in the current regular season (each, a “Prize” and collectively, the “Prizes”).
General Prize Term. The odds of winning a Prize will depend on the number of entries Sponsor has received by the end of the Promotion Period, or Entry Period as applicable, and will decrease as more entries are received. The right to receive a Prize is non-transferable and non-assignable. No cash redemption of a Prize is permitted except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the any Prize (or any portion thereof) with one of comparable or greater value at its sole and absolute discretion. All costs and expenses associated with any acceptance and use not specified herein as being provided, including but not limited to shipping costs, transportation costs, parking, food and beverages, souvenirs, gratuities and other expenses incurred by accepting and making use of any Prize, are the sole responsibility of the applicable Winner (and Winner’s guests, as applicable). All federal, state, or local taxes associated with the Prizes award in connection with the Promotion are each Winner’s responsibility. A form 1099 may be issued based on the value of the Prize as required by law. Winner may be required to execute and return any required affidavit of eligibility and/or liability/publicity release. To the extent requested, all such forms will be completed and returned within twenty-four (24) hours or Sponsor may disqualify a Winner.
Value. The approximate retail value of the Prize is $1,020.
7. Privacy Policy. Any personally identifiable information collected during an entrant’s participation in the Promotion will be collected by Sponsor and used by Sponsor and/or the Promotion Entities: (a) for purposes of proper administration and fulfillment of the Promotion as described in these Official Sweepstakes Rules; and (b) as described in each respective Promotion Entity’s privacy policy, posted on the Promotion Entity’s website. Telephone numbers and email addresses received via Contact Form entry may also be used to provide information and marketing materials from the Sponsor.
8. Release; Winner Publicity Release. By participating in the Promotion, each entrant agrees to release and hold harmless the Promotion Entities from and against any and all claims, injuries, damages or losses that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any Prize(s) awarded. Each entrant (irrespective of whether or not such entrant wins a Prize), grants to each of the Promotion Entities an independent, royalty-free, perpetual, irrevocable, fully transferrable, non-exclusive, worldwide right (but not obligation) and license to publicize and use such entrant’s name, address (city and state of residence), photograph, voice and/or other likeness and Prize information in any and all media now known or hereafter devised, without additional compensation or consideration, notification or permission, unless prohibited by law.
9. General. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Promotion Entities (a) do not make any warranty, guaranty or representation of any kind concerning the Promotion or a Prize (other than that any autographed memorabilia that may be awarded as a Prize is authentic and that items described as player-used have been actually used by a player) and (b) to the extent permitted by law, disclaim any and all express and implied warranties (including, without limitation, quality, merchantability and fitness for a particular purpose) relating to the Promotion and the Prize(s). The Promotion Entities are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, through e-mail or mail. Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. The Promotion Entities are not responsible for lost, interrupted or unavailable network, server, Internet service provider, website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prize(s) or in any Promotion-related materials. The Promotion Entities are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. 10. Indemnity; Disputes. By participating in the Promotion, each entrant agrees to indemnify and hold harmless each of the Promotion Entities from any and all liability arising out of or relating in any way to the entrant’s participation in the Promotion. Except where prohibited by law, each entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State and Federal courts located in the Essex County, State of New Jersey; (b) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH PARTICIPATING THIS PROMOTION AND/OR RECEIVING A PRIZE, BUT IN NO EVENT ATTORNEYS’ FEES; AND (c) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. 11. Winners List. All requests must be received by no later than thirty (30) days after the end of the Promotion Period.
12. Sponsor. The “Sponsor” of this Promotion is NJ/NY Gotham Football Club LLC.

Should a Potential Winner not meet the eligibility criteria or the entry be found, in Sponsor’s sole discretion, to not comply with these Official Rules, such Potential Winner will be disqualified and Sponsor may select an alternative Potential Winner. Every Eligible Entrant who submits an entry to the Promotion will also be automatically entered into any additional promotions run by Sponsor that contain a means of entry related to 2024 Season Ticket Membership renewals.
5. Winner Contact. Sponsor will attempt to contact each Potential Winner via e-mail within one (1) week after the end of the Promotion Period. Each Potential Winner who responds to Sponsor’s message and complies with all other terms of the Official Sweepstakes Rules, is a “Winner.” If a Potential Winner cannot be reached during such period or fails to respond to Sponsor within twenty-four (24) hours after said message is delivered, such individual will be disqualified and an alternative Potential Winner will be randomly selected from the remaining Eligible Entrants and contacted. Such process will continue until Sponsor contacts the number of Winners to award all Prizes. At all times, Sponsor reserves to right to select an alternate Winner in the event that a Winner is found to have not complied with these Official Sweepstakes Rules.
6. Prize Descriptions; General Prize Terms; Value.
Prize Descriptions. Two (2) Grand Prize Winners will receive free valet parking for 14 Gotham home matches at Red Bull Arena; and Thirty (30) Runner-Up Winners will receive $100 gift cards that can be used for the purchase of food/beverage during Gotham home matches at Red Bull Arena (each, a “Prize” and collectively, the “Prizes”).
General Prize Term. The odds of winning a Prize will depend on the number of entries Sponsor has received by the end of the Promotion Period, or Entry Period as applicable, and will decrease as more entries are received. The right to receive a Prize is non-transferable and non-assignable. No cash redemption of a Prize is permitted except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the any Prize (or any portion thereof) with one of comparable or greater value at its sole and absolute discretion. All costs and expenses associated with any acceptance and use not specified herein as being provided, including but not limited to shipping costs, transportation costs, parking, food and beverages, souvenirs, gratuities and other expenses incurred by accepting and making use of any Prize, are the sole responsibility of the applicable Winner (and Winner’s guests, as applicable). All federal, state, or local taxes associated with the Prizes award in connection with the Promotion are each Winner’s responsibility. A form 1099 may be issued based on the value of the Prize as required by law. Winner may be required to execute and return any required affidavit of eligibility and/or liability/publicity release. To the extent requested, all such forms will be completed and returned within twenty-four (24) hours or Sponsor may disqualify a Winner.
Value. The approximate retail value of each Grand Prize is $644. The approximate retail value of each Runner-Up Prize is $100.
7. Privacy Policy. Any personally identifiable information collected during an entrant’s participation in the Promotion will be collected by Sponsor and used by Sponsor and/or the Promotion Entities: (a) for purposes of proper administration and fulfillment of the Promotion as described in these Official Sweepstakes Rules; and (b) as described in each respective Promotion Entity’s privacy policy, posted on the Promotion Entity’s website. Telephone numbers and email addresses received via Contact Form entry may also be used to provide information and marketing materials from the Sponsor.
8. Release; Winner Publicity Release. By participating in the Promotion, each entrant agrees to release and hold harmless the Promotion Entities from and against any and all claims, injuries, damages or losses that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any Prize(s) awarded. Each entrant (irrespective of whether or not such entrant wins a Prize), grants to each of the Promotion Entities an independent, royalty-free, perpetual, irrevocable, fully transferrable, non-exclusive, worldwide right (but not obligation) and license to publicize and use such entrant’s name, address (city and state of residence), photograph, voice and/or other likeness and Prize information in any and all media now known or hereafter devised, without additional compensation or consideration, notification or permission, unless prohibited by law.
9. General. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Promotion Entities (a) do not make any warranty, guaranty or representation of any kind concerning the Promotion or a Prize (other than that any autographed memorabilia that may be awarded as a Prize is authentic and that items described as player-used have been actually used by a player) and (b) to the extent permitted by law, disclaim any and all express and implied warranties (including, without limitation, quality, merchantability and fitness for a particular purpose) relating to the Promotion and the Prize(s). The Promotion Entities are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, through e-mail or mail. Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. The Promotion Entities are not responsible for lost, interrupted or unavailable network, server, Internet service provider, website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prize(s) or in any Promotion-related materials. The Promotion Entities are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. 10. Indemnity; Disputes. 1. How to Enter for a Chance to Win. During the entry period (defined below), participants must fill out the corresponding form, complete all data fields, and read these Official Rules on the corresponding pages. All entry information shall be collectively referred to herein as the “Submissions” or each as a “Submission.” Submissions must comply with the Guidelines and Restrictions defined below.
By entering, each entrant warrants and represents the following with respect to the entrant’s Submission: (a) entrant is the sole and exclusive owner of the Submission; and (b) the Submission will not infringe on any rights of any third parties.
Limit of one entry per person.
All entries become the sole and exclusive property of NJ/NY Gotham Football Club LLC [henceforth referred to as “Gotham FC” or “Sponsor”] and receipt of entries will not be acknowledged or returned. Gotham FC is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Gotham FC.
In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address used to submit the entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service, or other organization that is responsible for assigning e-mail addresses.
2. Entry Period. The Giveaway Entry Period begins at 10:00am Eastern Time ("EST") on 8/26/2024 and ends at 11:59pm EST on 9/29/2024 ("Entry Period").
3. Eligibility. Participation is open to legal residents of NYC metro area (New York City, Long Island (Nassau and Suffolk counties), Lower Hudson Valley (Westchester and Rockland counties), Northern New Jersey (Bergen, Essex, Hudson, Morris, Passaic counties), Central New Jersey (Mercer, Middlesex, Monmouth, Somerset and Union counties), Southern Connecticut (Fairfield and Litchfield counties), who are at least twenty-one (21) years of age. Void elsewhere and where prohibited, taxed or restricted by law. In addition, employees, officers and directors of alcohol beverage suppliers, importers, wholesalers, distributors or retailers are not eligible to enter. All federal, state and local laws and regulations apply.
4. Submission Guidelines: By entering the Giveaway, each entrant agrees that entrant's Submission conforms to the Submission Guidelines as defined below (the "Guidelines") and that Gotham FC, in its sole discretion, may remove any Submission and disqualify an entrant or Submission from the Giveaway if it believes, in its sole discretion, that the entrant's Submission fails to conform to the Guidelines.
Gotham FC’s decisions are final and binding in all matters relating to the Giveaway, including, but not limited to, interpretation and application of these Official Rules. By entering the Giveaway, entrant fully and unconditionally agrees to be bound by these rules, which will be final and binding in all matters relating to the Giveaway.
5. Date of selection. Giveaway entrants will be selected for prizes with a random drawing from all eligible entries received on 9/29/2024 (at 11:59 p.m. EST). The odds of winning are based on the number of eligible entries received. Drawing will be conducted by a representative of Gotham FC.
6. Prize(s). There will be five (5) prize “Winners.” Each Winner will receive two (2) premium tickets to Gotham FC’s regular season home game on October 5th, 2024 versus Bay FC at Red Bull Arena in Harrison, New Jersey with kick-off at 7:30 p.m. EST. Each Winner will also receive two (2) bucket hats and two (2) scarves either to be picked up at the Johnnie Walker Fan Fest activation booth at Red Bull Arena on October 5 between 5:00 pm and 7:00 pm EST OR to be mailed by Gotham FC to the Winner to his/her residential address in New York, New Jersey or Connecticut.
Approximate Retail Value: $540.00 US each.
Total Approximate Retail Value of All Prizes: $ 2700.00 US.
Tickets are valid only for indicated Gotham FC soccer match and are subject to terms and conditions of use as indicated thereon/provided therewith as well as venue restrictions of Red Bull Arena. Winner and individual accompanying Winner to indicated Gotham FC soccer match as Winner’s guest must be 21 years of age or older and must sign and return a Liability/Publicity Release prior to the soccer match.
Tickets are not intended for use by anyone other than winner and his/her guest including but not limited to provision to another via re-sale, exchange or barter. Seat location will be determined by Sponsor in its sole discretion. The terms and conditions of tickets awarded will govern in the event the indicated soccer match cannot be played due to inclement weather, police action or any other force majeure. Winner and his/her guest agree to comply with all applicable Gotham FC and stadium regulations in connection with acceptance and use of the prize, including Gotham FC’s and Red Bull Arena’s code of conduct as well as all applicable laws designed to prevent the spread of COVID-19/Coronavirus.
If winner accepts prize without a guest, he/she will only receive one (1) ticket to the indicated soccer match and one (1) bucket hat and no substitute prize or compensation will be awarded.
Alcohol is NOT part of any prize.
Limit of one prize per family, household or address. Prizes are non-transferable. No substitutions or cash redemptions. In the case of unavailability of any prize/prize element, Gotham FC reserves the right to substitute a prize/prize element of equal or greater value. All taxes and any expenses are the sole responsibility of the winners including but not limited to travel to and from the indicated Gotham FC soccer match, parking at Red Bull Arena, meals, souvenirs and other incidentals.
7. Notification. Prize recipients will be notified by 3:00 pm EST on 9/30/2024 by Gotham FC by email and must complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release within a designated time period as a condition of prize award. If any potential winner cannot be contacted by 12:00pm EST on 10/3/2024, does not return the completed and signed Affidavit of
Eligibility and Liability/Publicity Release within the designated time period, if any prize or prize notification is returned as undeliverable, if any potential winner rejects his/her prize or in the event of noncompliance with these Giveaway rules and requirements, such prize will be forfeited. Upon prize forfeiture, no compensation will be given. Forfeited prizes may be awarded to alternate winners in Gotham FC’s sole discretion, time permitting. Gotham FC will use commercially reasonable efforts to contact potential prize recipients which may include attempting to contact a given potential prize recipient only one time. Gotham FC and Diageo Americas, Inc. disclaim any and all liability in conjunction with Gotham FC’s inability to contact a potential prize recipient regardless of cause.

9. Additional Terms. Any attempted form or entry other than as set forth above is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. Released Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, error or failures of any kind, lost or unavailable network connections, website, internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Giveaway, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway. 11. Disputes; Governing Law. The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Giveaway. Any controversy or claim arising out of or relating to these Official Rules and/or the Giveaway shall be settled by binding arbitration in accordance with the commercial arbitration rules of the JAMS Arbitration. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New Jersey, City of Whippany.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW JERSEY WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Giveaway, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to Morris County in the State of New Jersey. The parties agree to not raise the defense of forum non conveniens.

Employees, officers and directors, including immediate family members (spouse, domestic partner, child (biological, foster or adoptive), sibling, or parent (biological, foster or adoptive) and their respective spouses/domestic partners, regardless of where they reside), and members of the same household, whether or not related, of the NJ/NY Gotham Football Club LLC, the National Women’s Soccer League, and each of their respective parents, affiliated companies, subsidiaries, licensees, divisions, members, teams and any and all other companies associated with the Promotion (collectively, the “Promotion Entities”) are not eligible to participate or win a Prize. The Promotion is subject to all applicable federal, state and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation. Participation constitutes entrant’s full and unconditional agreement to these Official Sweepstakes Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion, including but not limited to the administration and operation of the Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein.
2. Promotion Period. The Promotion will begin on August 26th, 2024 at 8 a.m. Eastern Time and end on August 31st, 2024 at 12:00 p.m. Eastern Time (the “Promotion Period”). All entries must be received by Sponsor by the end of the Promotion Period. Sponsor reserves the right to extend or shorten the Promotion Period in its sole discretion, and to cancel, terminate, modify or suspend the Promotion for any reason in Sponsor’s sole discretion. Sponsor’s clock shall be the official clock of the Promotion.
3. How to Enter. There are two (2) ways to enter the Promotion:
a. Survey Submission. If you purchased tickets for the August 24, 2024 Gotham soccer match against the Portland Thorns and attended the match, timely submit a complete post-match survey linked in the post-match email you receive. Eligible Entrants that attend the match and complete a survey through the method outlined above will automatically receive one (1) entry into the Promotion. Incomplete surveys will not be eligible.; or
b. Data Form Submission. Eligible Entrants may go to https://share.hsforms.com/1ZVrNg38ATXKnV3JCHeDXOA2qnqi and complete the online entry form in its entirety.
Limit one (1) entry per Eligible Entrant and Eligible Entrants may only win one (1) Prize. No other form of entry will be accepted other than as described above. In the event of dispute over the identity of an Eligible Entrant, an entry will be deemed made by the Authorized Account Holder of the e-mail address submitted at the time of entry, and the Potential Winner may be required to provide identification sufficient to show that he/she is the Authorized Account Holder of such e-mail address. The “Authorized Account Holder” is deemed the natural person who is assigned to the e-mail address in question by the applicable Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted email address. It is solely the responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her e-mail or postal address.
4. Winner Selection. Sponsor will randomly select one total entry from all Eligible Entrants after the Promotion Period ends (each, a “Potential Winner”). Sponsor will attempt to contact the Potential Winner(s) in the manner described below. Should a Potential Winner not meet the eligibility criteria or the entry be found, in Sponsor’s sole discretion, to not comply with these Official Rules, such Potential Winner will be disqualified and Sponsor may select an alternative Potential Winner.
5. Winner Contact. Sponsor will attempt to contact each Potential Winner via e-mail within one (1) week after the end of the Promotion Period. Each Potential Winner who responds to Sponsor’s message and complies with all other terms of the Official Sweepstakes Rules, is a “Winner.” If a Potential Winner cannot be reached during such period or fails to respond to Sponsor within twenty-four (24) hours after said message is delivered, such individual will be disqualified and an alternative Potential Winner will be randomly selected from the remaining Eligible Entrants and contacted. Such process will continue until Sponsor contacts the number of Winners to award all Prizes. At all times, Sponsor reserves to right to select an alternate Winner in the event that a Winner is found to have not complied with these Official Sweepstakes Rules.
6. Prize Descriptions; General Prize Terms; Value.
Prize Descriptions. Each Winner will receive either a) 2 VIP tickets to Gotham FC’s next home match if the Winner does not have tickets to the match, or, b) 2 seat upgrades to VIP to Gotham FC’s next home match if the Winner already has purchased tickets to this match (each, a “Prize” and collectively, the “Prizes”).
General Prize Term. The odds of winning a Prize will depend on the number of entries Sponsor has received by the end of the Promotion Period, or Entry Period as applicable, and will decrease as more entries are received. The right to receive a Prize is non-transferable and non-assignable. No cash redemption of a Prize is permitted except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the any Prize (or any portion thereof) with one of comparable or greater value at its sole and absolute discretion. All costs and expenses associated with any acceptance and use not specified herein as being provided, including but not limited to shipping costs, transportation costs, parking, food and beverages, souvenirs, gratuities and other expenses incurred by accepting and making use of any Prize, are the sole responsibility of the applicable Winner (and Winner’s guests, as applicable). All federal, state, or local taxes associated with the Prizes award in connection with the Promotion are each Winner’s responsibility. A form 1099 may be issued based on the value of the Prize as required by law. Winner may be required to execute and return any required affidavit of eligibility and/or liability/publicity release. To the extent requested, all such forms will be completed and returned within twenty-four (24) hours or Sponsor may disqualify a Winner.
Value. The approximate retail value of the Prize is $480.
7. Privacy Policy. Any personally identifiable information collected during an entrant’s participation in the Promotion will be collected by Sponsor and used by Sponsor and/or the Promotion Entities: (a) for purposes of proper administration and fulfillment of the Promotion as described in these Official Sweepstakes Rules; and (b) as described in each respective Promotion Entity’s privacy policy, posted on the Promotion Entity’s website. Telephone numbers and email addresses received via Contact Form entry may also be used to provide information and marketing materials from the Sponsor.
8. Release; Winner Publicity Release. By participating in the Promotion, each entrant agrees to release and hold harmless the Promotion Entities from and against any and all claims, injuries, damages or losses that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any Prize(s) awarded. Each entrant (irrespective of whether or not such entrant wins a Prize), grants to each of the Promotion Entities an independent, royalty-free, perpetual, irrevocable, fully transferrable, non-exclusive, worldwide right (but not obligation) and license to publicize and use such entrant’s name, address (city and state of residence), photograph, voice and/or other likeness and Prize information in any and all media now known or hereafter devised, without additional compensation or consideration, notification or permission, unless prohibited by law.

The Promotion Entities (a) do not make any warranty, guaranty or representation of any kind concerning the Promotion or a Prize (other than that any autographed memorabilia that may be awarded as a Prize is authentic and that items described as player-used have been actually used by a player) and (b) to the extent permitted by law, disclaim any and all express and implied warranties (including, without limitation, quality, merchantability and fitness for a particular purpose) relating to the Promotion and the Prize(s). The Promotion Entities are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, through e-mail or mail. Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. The Promotion Entities are not responsible for lost, interrupted or unavailable network, server, Internet service provider, website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prize(s) or in any Promotion-related materials.
